Fragrances and ban on Lilial (Butylphenyl Methylproprional) in cosmetic products

The declaration as well as a ban of individual fragrances in cosmetics are comprehensively regulated in the EU Cosmetics Regulation VO (EG) 1223/2009. For most fragrances, a declaration obligation applies from a quantity of 10 mg/kg (for all leave-on products, e.g. body lotion) or 100 mg/kg (for all rinse-off products, e.g. shower gel).

Currently, a ban on making products available on the market that contain the fragrance Lilial (INCI: Butylphenyl Methylproprional), in whatever quantity, will take effect on 1 March 2022. This regulation comes from the hazardous substances legislation (REACH, CLP) due to a classification as a carcinogenic substance.

Furthermore, a significant expansion of the fragrances that must be declared is under discussion and is expected to be implemented in 2022 (with corresponding transitional periods regarding the first placing on the market or the sale of products).
