Amendment of Regulation (EC) No 853/2004 concerning the marketing of eggs as well as the storage and transport of fishery products
With the Delegated Regulation (EU) 2022/2258 published in the Official Journal of the European Union on 18.11.2022, some provisions of Regulation (EC) No. 853/2004 with specific hygiene rules for food of animal origin (Animal-LMHV) are updated.
A central change concerns the sale of eggs in the retail food market. Until now, the deadline for the sale of eggs to the final consumer after laying was 21 days. A sale to the consumer after the 21st day was prohibited and even punishable. Now, the sales period has been increased to 28 days, so the "best before date" (BBD) of eggs may also be set at a maximum of 28 days after laying. The main target was to reduce food waste since previously eggs had to be disposed of well before the end of their shelf life.
Additionally, in the field of fishery products, the regulations on temperature and transportation conditions have been revised to allow the use of 3-layer polyethylene containers as well as the application of the technique of so-called "Superchilling". When using the Superchilling process for fresh fishery products, the transport container must be labeled accordingly.
