Prohibition of Theophylline in Cosmetics – Regulation (EU) 1223/1490

Starting from December 2023, the so-called 6th Omnibus Regulation will come into effect, which, among other things, prohibits the substance theophylline (reproductive toxic category 1B) for use in cosmetics.

This ban is immediately valid, and no transition periods are foreseen. Therefore, cosmetics containing theophylline are not marketable in the EU and Switzerland from December 1, 2023.

The BfR Commission for Cosmetic Products considered a maximum value of 100ppm as an acceptable limit for cosmetics at its 28th meeting at the beginning of 2023.
