Amendment of Annex II of the FIC Regulation (EU) No 1169/2011 concerning the allergen mustard
On 25.09.24, the Delegated Regulation (EU) 2024/2512 of 17 April 2024 amending Annex II of Regulation (EU) No. 1169/2011 on the provision of food information to consumers concerning behenic acid derived from mustard seeds for use in the production of certain emulsifiers was published in the Official Journal of the EU.
Behenic acid is derived from mustard seeds and is used in the production of the emulsifiers E470a (sodium, potassium, and calcium salts of fatty acids), E471 (mono- and diglycerides of fatty acids), and E477 (propylene glycol esters of fatty acids). The EFSA concluded in a review that it is extremely unlikely that the consumption of these emulsifiers would trigger an allergic reaction in individuals allergic to mustard. Annex II was therefore amended as follows: “10. Mustard and products derived therefrom, except behenic acid with a purity of at least 85%, produced after two distillation steps, for the production of the emulsifiers E470a, E471, and E477.”
The regulation becomes effective on 15.10.2024 and applies from 01.04.2025. Foodstuffs legally placed on the market or labeled before 01.04.2025 that do not comply with this regulation may continue to be marketed until stocks of these foodstuffs are exhausted.
