Counter-sample experts at the BAV Institute
According to the Federal Office of Consumer Protection and Food Safety (BVL), a total of 34 counter-sample experts were approved in Baden-Württemberg as of March 2026. These experts are authorized to examine official counter-samples within the framework of food surveillance.
The procedure of the official counter-sample serves quality assurance and legal protection for food companies. If a sample is contested by the competent supervisory authority, the manufacturer has the option to have an official counter-sample analyzed by an independent and accredited laboratory. The counter-sample is taken by the authority and provided for examination under controlled conditions.
The aim of the counter-sample examination is the technically independent verification of the authority's test results. This can determine whether the objection can be scientifically confirmed or whether alternative assessments of product safety, marketability, or legal compliance apply. This procedure contributes to increased transparency and legal certainty and equally protects the interests of consumers, manufacturers and authorities.
