Decision support for "Exceptions to Nutrition Labelling"

The working group "Food, Commodities, Wine and Cosmetics" (ALB) of the State Working Group on Consumer Protection (LAV) dealt in October 2017 with the exemption from the nutritional declaration according to Annex V No. 19 of Regulation (EU) No. 1169/2011 (Food Information Regulation (LMIV)) and developed a decision-making aid on this subject.

According to Art. 16 para. 3 in conjunction with Annex V No. 19 LMIV, "foodstuffs, including artisanal foods, which are supplied directly in small quantities […] by the manufacturer to the final consumer or to local retail establishments which directly supply the products to the final consumer" are exempt from the mandatory nutritional declaration.

The decision-making aid primarily includes explanations of the terms "direct supply" and "small quantity" and concludes with examples and decisions from the responsible food monitoring authorities, presented in tabular form. The decision-making aid replaces the joint statement of ALS and ALTS, which was published in the course of the 74th working meeting of ALTS in December 2014.
