Fragrances and Lilial (Butylphenyl Methylpropional) in cosmetic products

The declaration and prohibition of individual fragrance substances in cosmetics are comprehensively regulated in the EU Cosmetics Regulation VO (EC) 1223/2009. For most fragrances, a declaration requirement applies from a quantity of 10 mg/kg (for all leave-on products, e.g., body lotion) or 100 mg/kg (for all rinse-off products, e.g., shower gel).

Currently, from March 1, 2022, a ban is in place on making products available on the market that contain the fragrance Lilial (INCI: Butylphenyl Methylproprional), regardless of the amount. This regulation stems from hazardous substance legislation (REACH, CLP) due to its classification as a carcinogenic substance.

Furthermore, a significant expansion of the fragrance substances that require declaration is under discussion and is expected to be implemented in 2022 (with corresponding transition periods regarding the initial marketing or sale of products).
