LFGB Transparency Law: Amended § 40 para. 1a LFGB comes into force on 30.04.19
Section 40, Paragraph 1a of the LFGB comes into force on 30.04.19. It was amended in several points before adoption:
- In Paragraph 1a, the word “immediately” is inserted after the words "The competent authority informs the public".
- The words "at least two independent investigations" are replaced by "at least two independent investigations by an institution". This makes it clear that the double investigation can be carried out by the same laboratory.
Furthermore, digit 2 is inserted after digit 1. It states that the public should also be informed if a legally unauthorized or prohibited substance is present in a food or feed.
A new addition in digit 3 is: "Violations of construction requirements that do not pose a risk of adverse effects on food, as well as recording or reporting obligations that do not pose a risk of adverse effects on food, are disregarded under sentence 1 number 3." This is to express that only violations of high relevance should be published.
New is Paragraph 4a, which states that the publication will be deleted after six months.
