Maximum residue levels for chlorate published under Regulation (EC) No. 396/2005
On June 4th, after several years of preparation, the Regulation (EU) 2020/749 amending Regulation (EC) No 396/2005 (EU Pesticide Regulation) regarding the maximum residue levels of chlorate in or on certain products was published in the Official Journal of the European Commission.
For the product types according to Annex I of the EU Pesticide Regulation (products of plant and animal origin), the maximum residue levels established in the Annex of Regulation (EU) 2020/749 apply.
For example, maximum residue levels of 0.05 mg/kg each for pome and stone fruits, berries, and small fruits, 0.07 mg/kg each for spices, or 0.1 mg/kg of chlorate for milk have been established.
According to the opinion of the EU Commission, no additional chlorate entries can be considered for the product types. In the case of fruits and vegetables, the product groups include both fresh and frozen goods.
For processed products falling under the regulations according to Article 20 of Regulation (EC) No 396/2005, additional chlorate entries can be claimed. This refers to new entries during processing. According to footnote (A) for chlorate, the burden of proof for these additional chlorate entries (e.g. through processing aids or drinking water) lies with the food or feed business operator.
No transitional arrangements were agreed for the new maximum residue levels and the new regulations for chlorate, so they will apply without restriction from June 28, 2020, onwards.
