In the three federal states of Baden-Württemberg, North Rhine-Westphalia, and Schleswig-Holstein, directives for the implementation of § 40 paragraph 1a of the LFGB have been published. A controversial point is the interpretation of the term "double examinations" in § 40 paragraph 1a of the LFGB.
The law states that as a prerequisite for publications in the event of sample limit exceedances, "at least two independent examinations by institutions..." must be available. However, the abovementioned directives of the federal states do not explicitly require that the examinations must be conducted by two different laboratories if publications are to be made.
Therefore, the BLL e.V. has published a detailed statement on this topic.
It remains to be seen how food monitoring will proceed in the event of such publications. We will keep you informed about developments on this matter.
