Re-regulation of Fragrance Ingredients in Cosmetics – Expected Early 2023

 

Currently, for cosmetics according to Regulation (EC) 1223/2009, the declaration of certain fragrance substances is required when their content is 10 mg/kg (for leave-on products) or 100 mg/kg (for rinse-off products). Furthermore, certain fragrance substances are prohibited or regulated in quantity (e.g., Lyral, Lilial, Methyl salicylate, etc.).

The declaration of allergenic fragrance substances is expected to be significantly expanded from the beginning of 2023. In addition to mono substances, a number of natural extracts must also be declared at the above-mentioned levels. It is still under discussion to what extent online declaration is possible. The transitional periods for providing or marketing will be 3 and 5 years, respectively.

The BAV Institute, as part of the international Tentamus laboratory group, is establishing the analysis of the expanded fragrance list.
