Amendment to the Consumer Information Act - In BAV Newsletter 04/2011

With a draft law to amend the Consumer Information Act, the Federal Government aims to improve public information, particularly through mandatory publication of all violations of legal regulations.

In addition to the food industry, the Federal Council also considers these far-reaching publication rights problematic in its statement dated 23.09.2011. The term "deviation from requirements" is too vague to justify such extensive disclosure of information by the authorities.

The food industry also criticizes that this constitutes an infringement of the fundamental rights of the affected companies. This is disproportionate for minor violations and is already regulated by § 40 of the LFGB concerning hazard prevention. A hearing on this matter took place before the Committee on Food, Agriculture, and Consumer Protection on 09.11.2011.
