Berlin "Smiley Lists" impermissible - In BAV Newsletter 03/2014

The Berlin districts of Lichtenberg and Pankow had published so-called "Smiley Lists" on the internet regarding the results of hygiene inspections of food businesses. As the administrative court had previously done, the higher regional court has now also prohibited this practice. The Consumer Information Act is not a legal basis for publication in the form of minus points, grades, colors, or smiley symbols.
