Cannabidiol (CBD) naturally occurs in the hemp plant. It belongs to the group of cannabinoids and has increasingly been used in recent years in food, dietary supplements, and pharmaceuticals. The European Industrial Hemp Association (EICA) published a classification of CBD-containing foods on March 3, 2020, which has now been revised by the Federal Office of Consumer Protection and Food Safety (BVL).

Cannabinoid-containing foods continue to fall under the so-called Novel Food Regulation. Neither the EICA nor other economic operators have been able to demonstrate that significant amounts of CBD-containing foods were consumed in the EU before May 15, 1997. Therefore, the classification by the Federal Office of Consumer Protection and Food Safety (BVL), as the nationwide responsible authority, remains unchanged.

Since CBD-containing foods have not yet been approved as Novel Foods, they are not permitted to be marketed. It must also be checked whether the product falls under the Narcotics or Pharmaceuticals Act. Products in these categories are not marketable as food.
