Amendment of §40 Paragraph 1a LFGB

In March 2018, the Federal Constitutional Court made a decision on §40 para. 1a LFGB, in which clear guidelines were established regarding the points to be observed so that the aforementioned legislative article is constitutionally compliant and can be applied.

The BLL published a detailed statement on this on 07.06.18 (www.bll.de). Furthermore, the Federal Ministry of Food and Agriculture (BMEL) has now developed a new draft. This draft proposes that §40 LFGB be supplemented by a paragraph 4a, which states

“(4a) The information according to paragraph 1a including additional information according to paragraph 4 is to be removed six months after publication”
