In the Regulation (EC) No. 2073/2005 on microbiological criteria for foodstuffs (Microbiological Criteria Regulation), Annex I stipulates that Salmonella Typhimurium and Salmonella Enteritidis must not be detectable in fresh poultry meat.
Salmonella can cause foodborne infectious diseases, which can be fatal in the worst case. Due to the high number of cases in humans, salmonellosis is one of the most important notifiable diseases.
The European Court of Justice (ECJ) in its judgment of 28.04.22 dealt with the question of how to proceed when the competent authorities detect other Salmonella serotypes in fresh poultry meat than those regulated in Regulation 2073/2005.
It was decided that the competent authorities may take appropriate measures in such cases. These may include restrictions on the marketing of food. This also refers to other microbiological criteria than those regulated by Regulation (EC) No. 2073/2005.
