Classification of titanium dioxide (TiO2) as carcinogenic "provisionally" not permissible
Titanium dioxide is a pigment that is used as a dye and primarily as a UV filter in cosmetic products and is listed in the annexes of Regulation (EC) 1223/2009. Due to potential negative health impacts, it is repeatedly under discussion. In 2019, the EU Commission classified it as carcinogenic and since 2022 it has been banned in foods.
In a recent ruling from early August, the European Court of Justice (ECJ) temporarily reverses this classification. According to the ruling, titanium dioxide may not be labeled as "carcinogenic" for the time being. The ECJ justifies this by stating that not all available, relevant points were sufficiently considered in the initial assessment. Manufacturers had filed a lawsuit against the classification.
