The ECHA (European Chemicals Agency) has, at the request of the EU Commission, created a proposal for quality requirements for tattoos and permanent make-up to ensure the quality of these products permanently. The number of tattoos in the population is steadily increasing. Because tattoos are injected under the skin, these products do not fall under the legal framework for cosmetic products ((Regulation (EC) 1223/2009)). Instead, the general product safety directive applies to these products, and their safety must be ensured by the distributor.

The aim of this proposal is to replace an existing Commission recommendation from 2008 (RES AP 2008) and to create uniform standards for all products.

In addition to maximum levels for heavy metals (including mercury, antimony, arsenic, cadmium, lead), residual levels of methanol and polycyclic aromatic hydrocarbons (PAHs) are to be regulated. Furthermore, the use of dyes is specified.

Moreover, the microbiological quality of tattoo inks is of crucial importance. The tests in this regard are generally carried out in accordance with cosmetic regulations, i.e., according to the standards of DIN EN ISO 17516.
