Both the European Court of Justice (ECJ) and the Bavarian Administrative Court agree.
For portion packs in collective packages (e.g., honey or jam) delivered to community caterers (e.g., restaurants, canteens), there is a full declaration obligation according to Article 9 of the Food Information Regulation (FIR).
Even if they do not sell the portion packs individually, but provide them as part of a meal (e.g., breakfast with a packaged jam portion).
With this ruling, the court contradicts the decision of the ALTS, which considers this comprehensive labeling unnecessary. However, since the ALTS only provides recommendations, the court's ruling is regarded as legally binding.
