Cosmetics and Confusion with Food Products
The upcoming autumn and winter season is also bathing season and gift-giving time. Solid soaps and bath additives are always trendy for this purpose. These can strongly resemble foods visually and, above all, in terms of smell. This increases the risk that they may be taken into the mouth and swallowed (especially by children).
In a 2022 ruling, the CJEU decided that certain cosmetic products may not be sold if there is a danger to consumer health, particularly for children, due to them being mistaken as something else.
However, there is no general ban. The presence of these conditions must be examined by national authorities on a case-by-case basis.
