On June 22, 2018, the Federal Ministry for Economic Affairs and Energy published the draft regulation "Ordinance to Amend the Law on Prepackaged Products." An amendment to the Prepackaging Ordinance is necessary to adapt the law on prepackaged products to European developments and national changes in measurement and calibration law. The current Prepackaging Ordinance largely dates back to the 1970s, requiring a modernization of the terminology, among other things. As a result, the majority of existing regulations will be retained but will be specified and newly structured in a more transparent manner to relieve consumers, manufacturers, and enforcement authorities. This aims to create higher transparency and improve legal certainty.

For example, the definition of "prepackaged food" from Regulation (EU) No. 1169/2011 (Food Information Regulation) is being adopted to create a link to the term "prepackaged food products." In our view, the two terms can be considered equivalent under the current status.

Additionally, the time of production is legally defined. Unless otherwise specified, this refers to the point in time when the product is combined with the outer packaging, sealed, and the required labeling features are applied.
