Draft for the "Mineral Oil Regulation"

The Federal Ministry of Food and Agriculture has forwarded the draft of the "Mineral Oil Regulation" (22nd Ordinance to Amend the Ordinance on Articles of Daily Use) to the industry for acknowledgment.

The draft ordinance essentially provides for an obligation to use a functional barrier in the manufacture/marketing of food contact materials/items (LKM) made from recycled paper material. This is intended to prevent the migration of aromatic mineral oil hydrocarbons (MOAH) in order to take health consumer protection into account.

In exceptional cases, LKM can also be manufactured/marketed without a functional barrier if the food business operator using the LKM ensures through suitable measures/conditions that the migration of MOAH is below the specified limit of detection.

The limit of detection for the evidence that no migration of MOAH occurs is 0.5 mg MOAH/kg food for migration into food. If corresponding tests are carried out with food simulants instead of in food, a limit of detection of 0.15 mg MOAH/kg food simulant applies. This is because, due to fewer interfering influences, mineral oil analysis can be carried out much more sensitively in the food simulant. We will keep you informed about further developments.
