At the Bavarian Administrative Court (BayVGH), the prohibition order against an ice cream producer was reviewed. The competent authority prohibited the marketing of ice cream products containing locust bean gum contaminated with 2-chloroethanol (main degradation product of ethylene oxide).
However, the BayVGH considered the final and indefinite prohibition order to be unlawful and emphasized that the authority should have considered a temporary prohibition order. After the publication of new scientific findings, the facts should have been reviewed and potentially re-evaluated.
