Harmonization of allergen contamination at EU level
The European Commission plans to harmonize the labeling of allergen contamination. While in Germany, the term “Spurenkennzeichnung” is used, on an international level it is referred to as “precautionary allergen labelling” (PAL).
The harmonized regulations are to be implemented by an implementing regulation expected in the fourth quarter of 2027. This measure is the EU Commission's response to the pressure from member states: for instance, the Netherlands most recently introduced PAL guidelines earlier this year.
The Food Information Regulation (FIR) explicitly permits the issuance of such an implementing regulation, but this possibility has not yet been utilized. A corresponding draft will likely be presented by the Commission for public consultation soon. Representatives of the food industry, consumer associations, and other interest groups will have the opportunity to comment. The objective is to ensure that the final regulation offers a balanced relationship between consumer protection and practical feasibility.
However, it remains unchanged that the labeling of inadvertent allergen entries is done on a voluntary basis. Those who choose to provide this information will, in the future, have to comply with the requirements of the implementing regulation.
This harmonization marks an important advancement in the EU food labeling policy and closes a gap that has existed since 2011.
