Horsemeat Scandal: Obligation to Publish in Cases of Gross Deceptions - BAV Newsletter 02/2013

With a short-term amendment to the Food and Feed Code (LFGB), it is now to be stipulated that authorities must in future inform about gross deceptions in food. The new § 40 paragraph 1 sentence 2 number 4a is to be inserted into the LFGB. This will also enable public information to be provided if there is a reasonably substantiated suspicion, based on facts, that deception protection regulations of the LFGB have been violated "to a non-negligible extent". In principle, the obligation to hear parties as well as the priority information option for the public by the affected company itself continues to exist.
