By decision of March 21, 2018, the Federal Constitutional Court (BVerfG) ruled that the obligation for official information on violations of food and feed law is generally constitutional, but must be time-limited.
With a draft bill from the Federal Ministry of Food and Agriculture (BMEL), Section 40 of the German Food and Feed Code (LFGB) is now supplemented with a statutory deletion period. A publication period of violations over a period of six months appears to the BMEL, balancing the fundamental rights interference for the affected company and the value of the information for consumers, to be sufficient and appropriate - information must be removed after this time period.
