Introduction of maximum levels for nickel in certain foods in Regulation (EU) 2023/915

On July 30, 2024, Regulation (EU) 2024/1987 amending Regulation (EU) 2023/915 regarding maximum levels for nickel in certain foods was published. 

Maximum levels for nickel are introduced for the following product groups: 

- Nuts (“Tree nuts”), 
- Vegetables including fresh herbs and seaweed, 
- Legumes, 
- Certain oilseeds (sunflower seeds, peanuts, soybeans)
- Chocolates and cocoa powder, 
- Baby food (infant formulas, cereal-based complementary foods, other complementary foods) as well as 
- Fruit juices, fruit nectars, and vegetable juices (for infants and young children as well as for general consumption (Position 3.6.16)

The maximum levels for nickel in the aforementioned foods apply from July 1, 2025, and thus from the effective date of Regulation (EU) 2024/1987. This does not apply to the maximum levels for cereals including pseudocereals, which only apply from July 1, 2026, thus one year later than the other maximum levels for nickel in foods. 

For foods that were legally placed on the market before the new maximum levels for nickel came into effect and may not comply with the new maximum levels, usage possibilities are granted until the end of their best-before date or expiry date. 

The Regulation (EU) 2024/1987 will enter into force on August 20, 2024, and will be applicable from July 1, 2025.
