Is sushi a fresh fishery product?

By a decision of the Administrative Court (VG) Regenburg from April 2025, the immediate enforceability of an administrative order to convert sushi offerings to +4°C was revoked. 

In the court's view, sushi does not fall under the definition of "fresh fishery products" regulated in Regulation (EC) No. 853/2004 Annex I No. 3.5. For sushi, the fish used as a "fishery product" is merely an ingredient. This statement is also confirmed by the guidelines for fish and fishery products in the German Food Book (No. 1.1.5 "Fish for raw consumption"). Based on this, the court concluded that the hygiene regulations for "fresh fishery products" according to Regulation (EC) No. 835/2004 are not directly applicable to sushi in retail.
