Judgment: Warning Notice on Raw Kassler - In BAV Newsletter 04/2012
A packaged, raw “Kasseler pork chop” must carry an appropriate notice that the food must be adequately cooked before consumption. Otherwise, it is to be classified as unsafe food in the event of a positive salmonella finding.
This was decided by the Administrative Court of Berlin after salmonella was detected in a sample of "Kasseler pork chop," but the product did not carry a warning about cooking thoroughly. The decisive factor is that Kasseler products are available both raw and already cooked.
Without specific information on the packaging, it is not unmistakably clear to the consumer whether it is a product that has not yet been cooked.
