KWG Lawyers: The European Court of Justice clarifies indication of the country of origin of “cultivated mushrooms”
The European Court of Justice (ECJ) has ruled on the application of geographical indications or origin designations for cultivated mushrooms.
What is the country of origin for cultivated mushrooms if the harvest takes place, for example, in Germany and the mushrooms are transported to Germany only three or fewer days before harvest?
The ECJ has decided that the country of origin for cultivated mushrooms is the country of harvest (Germany).
Even if the transportation of the mushrooms to Germany takes place only a few days before harvest, and significant production steps have occurred in other Member States of the European Union, the country of origin is deemed to be the country of harvest.
With this decision, the ECJ does not reflect the current interests of consumer protection policy, which demands greater transparency in the use of geographical indications for food products.
