Legal classification of Bubble Tea
At the 126th meeting of the working group of the food chemical experts of the states and the Federal Office for Consumer Protection and Food Safety (ALS), a resolution was made regarding the legal classification and labeling of bubble tea.
Bubble tea is legally classified as a soft drink. Because the term "Tea" is included in the name, it is assumed that the drink can contain tea and thus natural caffeine. Therefore, no additional caffeine warning is required as long as no isolated caffeine has been added.
If bubble tea contains additives, they must be labeled according to the applicable regulations. For certain colorants, the notice "May affect activity and attention in children" is also mandatory.
If there is a risk that consumers could choke on the bubbles (aspiration), it is recommended to provide a warning. Additionally, declarations of conformity must be available for materials that come into contact with the drink (e.g., cups or straws).
