New BVerwG Ruling: Non-Edible Components Do Not Count Towards Net Fill量
On May 6, 2025, the Federal Administrative Court (BVerwG) ruled: Non-edible components such as sausage casings, metal clips, threads, nets, or wax coatings are not part of the net weight, but are considered packaging (tare).
For manufacturers, this means: Only the actually consumable portion may be included in the net weight. Weighing in casings or closures violates labeling requirements and risks complaints, fines, or sales bans.
With the ruling, the BVerwG follows the calibration offices and ends a years-long legal dispute. It remains unclear whether the rule can also be applied to components such as wooden skewers in kebabs or shrimp shells.
Conclusion: Companies should review their labeling processes to avoid warnings and sales stops.
