New: Food Additive Implementing Regulation (LMZDV)
The Ordinance implementing Union legal provisions on food additives (Food Additives Implementation Ordinance - LMZDV) dated 02.06.2021 came into force on 09.06.2021. At the same time, the Additive Approval Ordinance (ZZulV) and the Additive Traffic Ordinance (ZVerkV) have ceased to be in force.
The ordinance is intended to consolidate national regulations that go beyond the European Regulation (EC) No. 1333/2008 on additives.
This particularly concerns the labeling of additives in non-prepackaged foods, the labeling of prepackaged beverages with an alcohol content of more than 1.2 percent by volume, as well as fruits and vegetables.

For the hospitality industry and communal catering, the following opportunity arises: guests must still be informed about the additives contained in the food and beverages. Previously, unlike allergens, the information had to be provided in writing at the point of sale for non-prepackaged foods. This has now changed. In the future, information about additives may be provided verbally, similar to allergens, if the following conditions are met (see also §4 Food Information Implementation Ordinance (LMIDV)):
- The necessary information must be provided to guests immediately upon their request before concluding the purchase and before delivering the food.
- A written record of the additives used in the production of the respective food must be available, which is easily accessible to the competent authority and on request by the guests.
- The relevant foods or a notice in the sales location must indicate in a clearly visible, prominent, and legible manner that the necessary information is provided verbally and that a written record is accessible upon request.
