New labeling regulations for non-prepackaged food
On June 9, 2021, the Regulation for the Implementation of Union Law Provisions on Food Additives (Food Additives Implementation Regulation - LMZDV) came into force. At the same time, the Additive Approval Regulation (ZZulV) and the Additive Traffic Regulation (ZVerkV) were repealed.
The regulation aims to integrate national regulations that go beyond the European Regulation (EC) No. 1333/2008 on additives.
This particularly concerns the labeling of additives in non-prepackaged foods, the labeling of prepackaged beverages with an alcohol content of more than 1.2 percent by volume, as well as fruits and vegetables.
Foodservice businesses and communal catering now have the following new possibility: Guests must still be informed about the additives contained in the food and drinks. Previously, unlike allergens, this information had to be provided in writing when distributing non-prepackaged foods. This has now changed. In the future, information about additives can also be provided orally, similar to allergens, if the following conditions are met (see also §4 Food Information Implementation Regulation (LMIDV)):
- The required information must be provided to guests upon their request promptly before the purchase is completed and before the handover of the food.
- A written record of the additives used in the production of the respective food must be available, which is easily accessible to the competent authority and upon guest request.
- There must be a clear and well-readable indication, either on the respective foods or in a notice at the point of sale, that the required information is provided orally and that a written record is available upon request.
