New Prepackaging Regulation in force since 01/12/2020
The new "Regulation on Prepackaged Products and Other Sales Units" has been in effect since December 1, 2020. An amendment to the Prepackaged Products Regulation was necessary to adapt the prepackaged products law to European developments and to national changes in metrology and calibration law. There was, among other things, a need for modernization regarding the terminology. As a result, a large part of the existing regulations remained, but they were specified and restructured to relieve consumers, manufacturers, and enforcement authorities. This is intended to create greater transparency and better legal certainty.
For example, in § 2 No. 10, the time of production is specified. This refers to the time when the product is joined with the outer packaging and it is sealed, and the necessary labeling features are applied. Different production times, such as for smoked goods, firm raw sausages, ice cream, or fruit and vegetable preserves, are listed in Annex 2.
The specified values for negative deviations from the nominal filling quantity are now both - for nominal filling quantities in general and for drained weights - presented in tabular form in § 9 Paragraphs 3 and 4.
§38 continues to include its own regulation regarding font size for filling quantity indications. The requirements for font size have not changed compared to the old regulation. However, for multipacks, a uniform font size of at least 4 mm must be specified in § 38 Paragraph 4.
