Nutri-Score: Notification in Brussels and translation for registration procedure
The Federal Ministry of Food and Agriculture submitted the national regulation on the Nutri-Score for notification to the European Commission on March 10.
Accordingly, the Food Information Implementation Regulation (LMIDV) will be supplemented by §4a. §4a LMIDV is simple and essentially states that food products with Nutri-Score labeling can be marketed, and the use of the label is voluntary.
The background of the notification is that the Nutri-Score must first be legitimized by a national regulation since it is used for labeling and evaluating food products and, without legitimization, would be prohibited as a nutritional and/or health-related claim. The legitimization is based on Article 23 (1) of the Claims Regulation (Regulation (EC) No 1924/2006).
The notification is associated with a waiting period of approximately 6 months, meaning the regulation is expected to come into force no earlier than October or November 2020.
Furthermore, the Federal Ministry has published German translations of the French texts for the registration procedure and the conditions of use for Nutri-Score on its website to assist businesses. The translations are intended to make it easier for small and medium-sized enterprises in the food industry to prepare for the introduction of Nutri-Score and participate in the system early on.
