Officially retained counter samples – what is that?
The official food control conducts risk-oriented sampling of products that fall under the Food and Feed Code (LFGB) at regular intervals for consumer protection purposes. These include, for example, food, consumer goods, and cosmetic products. These samples are analyzed by the testing agencies (e.g., Baden-Wuerttemberg: Chemical and Veterinary Investigation Offices (CVUA)) and subsequently assessed for their compliance with legal requirements.
During official sampling, according to §43 section 1 LFGB or §31 section 3 Tobacco Product Law, an official counter sample (part of the collected sample) must be left at the drawing location. The counter sample serves as evidence and can be used for a counter analysis with a corresponding counter report. Counter analyses may only be conducted by approved counter sample experts.
