Omnibus VI reform package for cosmetics published

On July 8, 2026, the European Commission notified the World Trade Organization (WTO) about the "Omnibus Act IX." This package integrates all innovations regarding CMR substances and new SCCS assessments into the European Cosmetics Regulation (EC) No 1223/2009.

In total, 16 new substances will be added to the list of prohibited substances in cosmetic products (Annex II of Regulation (EC) No 1223/2009), including

Benzophenone-1
Benzophenone-2
Prostaglandins and their analogues

Additionally, the entries of restricted substances in cosmetic products (Annex III of Regulation (EC) No 1223/2009) will be supplemented:

Hydroxyapatite (nano): adjustment of maximum concentrations in mouthwash and toothpaste
Cannabidiol (CBD): 0.19% as maximum concentration, with THC contamination limited to 2.5 ppm
Butylated Hydroxyanisole (BHA): 0.07% as maximum concentration with restriction on areas of application

Furthermore, the era of permissible mercury-containing preservatives in cosmetic products (Annex V of Regulation (EC) No 1223/2009) comes to an end. The entries under serial numbers 16 and 17

Phenylmercury and its salts

will be moved to Annex II to the list of prohibited substances.
