REACH (EC) 1907/2006 and Regulations for Cosmetics

 

New material regulations for ingredients of cosmetic products are usually adopted through amendments to the EU Cosmetics Regulation VO (EG) 1223/2009.

In addition, certain substances and substance classes can be newly regulated or banned under chemical law. This ban then applies immediately (without transition periods) to all cosmetics, and the use in other consumer products is also prohibited.

The ECHA (European Chemicals Agency) is responsible for this regulation under chemical law according to REACH. Thus, any EU country or the European Commission can pursue a restriction (e.g., octocrylene by France).

Furthermore, so-called CRM substances (carcinogenic, toxic to reproduction, mutagenic) are restricted or forbidden by the so-called Omnibus Regulations.
