Regulation on Bisphenol A in food contact materials

On February 14, 2018, the European Commission published Regulation (EU) 2018/213 in the Official Journal on the use of Bisphenol A in varnishes and coatings intended to come into contact with food, and amending Regulation (EU) No. 10/2011 as regards the use of this substance in plastic food contact materials.

Under the regulation, the specific migration limit (SML) for Bisphenol A (BPA) in plastic materials for food contact in the Plastics Regulation (EU) No. 10/2011 is reduced to 0.05 mg BPA/kg food. The same SML for BPA now also applies to "varnishes" and "coatings" of food contact materials (e.g., beverage cans).

Furthermore, the regulation extends the ban on the use of BPA in baby bottles (made from polycarbonate) to the production of "drinking vessels and bottles that are due to their spill-proof design intended for infants and young children".
