Salmonella in "Kinder" chocolate: Did the food manufacturer comply with reporting obligations?
In December 2021 and January 2022, Salmonella were detected during internal controls at the Belgian factory of the chocolate manufacturer “Ferrero” in two buttermilk tanks. Due to numerous cases of illness, Ferrero had to close the factory in Belgium on the orders of the authorities in April. Products from this location were subject to a mass recall. An end to this scandal is still not in sight.
The Belgian prosecutor's office announced that documents and computers have now also been seized during the current investigation. It is to be clarified whether Ferrero violated its reporting obligations as a food manufacturer and the legal requirements for food safety and hygiene.
In Germany, in addition to the reporting obligations under the General Food Law Regulation (Regulation (EC) No. 178/2002), there are also the reporting obligations under the Zoonoses Regulation for food manufacturers. Information on these reporting obligations can be found on our homepage. There you will also find our profiles on Salmonella and other pathogenic germs such as Campylobacter and Listeria monocytogenes.
