EU judges make landmark ruling on CBD products
In a recent ruling, the European Court of Justice decided that cannabidiol (CBD) isolated from hemp should not be classified as a narcotic. The consequences of this ruling for the food and cosmetics industry are still unclear.
The judges stated that it has not been proven that CBD has a psychotropic or harmful effect.
This ruling supports the view that the previous, very technical interpretation by the EU Commission, that CBD is to be classified as a narcotic, is no longer tenable. To date, foods enriched with CBD extracts are not marketable without an appropriate approval procedure according to the Novel Food Regulation.
It is expected that the EU Commission will reconsider its stance on CBD, with a decision anticipated by the end of the year.
