The controversial pesticide glyphosate may be used in the EU for another ten years according to a decision by the EU Commission, which is regretted by Federal Minister of Agriculture Cem Özdemir and the Greens. Özdemir announced that he would examine all options, including national bans or stricter guidelines for dealing with glyphosate.

A challenge for Özdemir, however, is that a national ban is difficult to implement. Despite a glyphosate ban issued by his CDU predecessor Julia Klöckner from 2024, there are doubts about whether this would stand up in court. The EU regulation determines which pesticides may be used in member states. Although it is possible for a member state to refuse approval of a substance despite EU approval, strong arguments are required for this.

Previous attempts, such as Luxembourg's attempt to ban glyphosate, have failed in court. If Germany were to impose a national ban despite existing EU approval, lawsuits could threaten. This is also demonstrated by the case of Bayer AG, one of the largest producers of the pesticide, which sued against Luxembourg's glyphosate ban. Apart from legal challenges, Özdemir also faces the support of conventional farmers who see glyphosate as indispensable and argue against an EU ban. These hurdles could complicate the implementation of further measures.
